These Terms of Services apply to all user of the PodPitara website, including users who are also contributors of text, images, audio and other content, information, and other materials or service on the website. The PodPitara website may contains links to third party websites that are not owned or controlled by PodPitara. PodPitara has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites.

Except for content which you upload to the site, all of the audio, photos and material on this site is owned and controlled by us. Please respect their interests and rights by not copying or sharing the content except as permitted on the site.

If and when necessary, PodPitara will co-operate with lawful authorities in relations to the interception, take-down and disclosure of User content which comes to our attention and appears to be unauthorised or illegal, which for the avoidance of doubt may include providing all your content and identification details held by us to such lawful authorities.

Basic Terms

PodPitara is not for pornography. If this describes your audios, videos, photos even if they are content of yourself, don’t post them on PodPitara.com.

Respect copyright. Only upload media contents(audios, videos, photos etc) that you made or that you have obtained the rights to use. You represent and warrant that: (i) you own the Content posted by you on the PodPitara websites or otherwise have the rights to grant the license, and (ii) your posted content does not violate the privacy rights, publicity rights, copyright rights, or other intellectual property rights of any third party entity. You agree to pay for all royalties and fees owing any person by reason of any Content you post on the PodPitara website.

PodPitara service makes it possible to post audios, photos hosted on PodPitara.com to outside websites. This use is accepted. However, pages on other websites which embed audios, photos that hosted on PodPitara.com mustprovide a link back to PodPitara.com from each embedded content to its Post page on PodPitara.com.

Please take these rules seriously and take them to heart. Violations of the Terms of Use may result in a warning notification or may result in termination of your account and deletion of all your post contents. We decide whether we believe your violation of our Terms of Use should result in termination of your account. If you have an account terminated, you are prohibited from ever signing up for another account!

The Services are available only for people aged 13 or older. We reserve the right to block your access to the Site and the Services if we have reason to believe that you are under 13.

PodPitara Service

As used herein, the term "Service" means any service provided by PodPitara via the Site, including, but not limited to, the provision by PodPitara to you of specified connectivity, storage space and bandwidth for the hosting of a your text, audio or video blog site by PodPitara. You also understand and agree that the Service may include advertisements and that these advertisements are necessary for PodPitara to provide the Service. You also understand and agree that the service may include certain communications from PodPitara, such as service announcements, administrative messages and the PodPitara Newsletter, and that these communications are considered part of PodPitara membership and you will not be able to opt out of receiving them. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new PodPitara properties, shall be subject to the term of service. You agree not to access the Service by any means other than through the interfaces that are provided by PodPitara for use in accessing the Service. Furthermore, whenever these Terms of Use refer to your use of the Site, said use shall be meant to include, but not be limited to, your use of any Service offered by PodPitara via the Site. You will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose.

Account

You may need to create an account with Us to login and access or use the PodPitara software or certain features of the App. Your account is personal to you and may not be transferred to or shared with others.

You are responsible for keeping your account and login details secure and are responsible for all activities that are carried out under them. You should choose a strong, unique password, which you do not disclose to anyone else or use with any other service. We will not be responsible for any losses suffered by you in circumstances where your account is used by someone else, unless this is caused by our negligence.

Remedy

If you breach the PodPitara Terms, then (without limiting any other remedy We may have), We may at our sole discretion, disable, partially disable, modify, or delete any or all of your accounts, block your IP address or Device from accessing our Services or in any other lawful way partially or fully restrict your access to any of our Services. This shall not limit our right to take any other action against You that We consider appropriate to defend our rights or those of any other person.

Changes to the PodPitara Terms

Revisions and Errata

The materials appearing on PodPitara web site could include technical, typographical, or photographic errors. PodPItara may make changes to the materials contained on its web site at any time without notice.

Governing Law

Any claim relating to PodPitara’s web site shall be governed by the laws of the State of India without regard to its conflict of law provisions.
